1. Agreement to Terms
By accessing or using the Hishebi Business website (https://hishebibusiness.com), mobile applications, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately discontinue use of our Services.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and MD Tayobur Rahman, operating as Hishebi Business, a product of Hishebi Softwares (https://hishebisoftwares.com) ("Company," "we," "us," or "our"), governed by the laws of the People's Republic of Bangladesh, including the Contract Act, 1872, the Personal Data Protection Ordinance, 2025, and the Cyber Security Act, 2023.
2. Eligibility
You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use our Services. By using our Services, you represent and warrant that:
• You are at least 18 years of age.
• You have the legal capacity and authority to enter into these Terms under the Contract Act, 1872 of Bangladesh.
• You will use the Services only for lawful purposes and in accordance with these Terms.
• You are not prohibited by any applicable law, regulation, or government order from using the Services.
• The information you provide is accurate, current, and complete.
3. Account Registration
3.1 Creating an Account
To access certain features of our Services, you must register for an account. When you register, you agree to provide accurate, current, and complete information and to keep that information up to date.
3.2 Account Security
You are responsible for:
• Maintaining the confidentiality of your account credentials (username and password).\n• All activities that occur under your account, whether or not authorized by you.\n• Notifying us immediately at mdtayobur.rahman@hishebisoftwares.com of any unauthorized use of your account or any other security breach.
We will not be liable for any loss or damage arising from your failure to maintain the security of your account.
3.3 Account Termination
We reserve the right to suspend or terminate your account at our sole discretion if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or posed a security risk. Where practicable, we will provide prior notice and an opportunity to remedy the breach before termination.
4. Description of Services
Hishebi Business provides a financial management and business tracking platform that may include:
• Income & Expense Tracking: Tools to record, categorize, and analyze your daily financial transactions.\n• Debt Management: Features to track money owed to or by you.\n• Savings & Budget Planning: Tools to set savings goals and manage budgets.\n• Business Reports: Summaries and visual reports of your financial data.\n• Home Owner & Business Toolkit: Additional tools tailored for small business owners and home management.
We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time. We will endeavor to provide reasonable advance notice for material changes that affect your use of paid features.
5. Acceptable Use
5.1 Permitted Uses
You may use our Services only for lawful personal or business financial management purposes in accordance with these Terms and all applicable laws of Bangladesh.
5.2 Prohibited Conduct
You agree NOT to:
• Use the Services for any unlawful purpose or in violation of any local, national, or international law or regulation, including the Cyber Security Act, 2023 of Bangladesh.\n• Enter false, misleading, or fraudulent information into the platform.\n• Attempt to gain unauthorized access to any portion of the Services, other accounts, or systems connected to the Services.\n• Engage in any conduct that restricts or inhibits any other user's use or enjoyment of the Services.\n• Use the Services to transmit any malware, viruses, or other malicious code.\n• Scrape, crawl, or use automated tools to extract data from our Services without our prior written consent.\n• Reverse engineer, decompile, or disassemble any part of our software or Services.\n• Sublicense, sell, resell, transfer, assign, or commercially exploit the Services without our express written permission.\n• Impersonate any person or entity or misrepresent your affiliation with any person or entity.\n• Use the Services in any manner that could damage, disable, overburden, or impair our infrastructure.
Violation of these prohibitions may result in immediate suspension or termination of your account and may expose you to civil or criminal liability under applicable law, including the Cyber Security Act, 2023.
6. Intellectual Property
6.1 Our Property
All content, features, and functionality of the Services — including but not limited to text, graphics, logos, icons, software, and the compilation thereof — are the exclusive property of Hishebi Business (a product of Hishebi Softwares) or its licensors and are protected by applicable copyright, trademark, patent, and other intellectual property laws of Bangladesh and international treaties.
6.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for your personal or internal business financial management purposes, in accordance with these Terms. This license does not include any right to modify, distribute, or create derivative works from the Services.
6.3 Your Content
You retain full ownership of all financial data and content you input into the Services ("User Content"). By submitting User Content, you grant us a limited, worldwide, royalty-free license to use, store, process, and display your User Content solely to provide, maintain, and improve the Services for you. We do not claim ownership of your data, and we will not use your User Content for any purpose other than providing the Services without your explicit consent.
6.4 Feedback
If you voluntarily submit suggestions, ideas, or other feedback about the Services, you agree that we may use such feedback without any obligation of compensation or attribution to you. This does not affect your rights over your User Content.
7. Subscription and Payment Terms
7.1 Free and Paid Plans
We may offer both free and paid subscription tiers. Specific features, limits, and pricing are described on our website and may change from time to time.
7.2 Billing
If you choose a paid plan, payment is due in advance for each billing period (monthly or annually, as selected). We may use third-party payment processors to handle transactions. All fees are final and strictly non-refundable. Hishebi Business does not provide refunds under any circumstances, except where mandated by the Consumer Rights Protection Act, 2009 of Bangladesh. Please refer to our Refund Policy for complete details.
7.3 Cancellation
You may cancel your paid subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds — including prorated refunds for unused portions of a subscription period — will be issued. See our Refund Policy for details.
7.4 Changes to Pricing
We reserve the right to change our pricing at any time. We will provide at least 30 days' advance notice before any price increase takes effect for existing subscribers. You may cancel before the new pricing applies.
8. Privacy and Data Protection
Your use of our Services is governed by our Privacy Policy, available at https://hishebibusiness.com/privacy-policy, which is incorporated into these Terms by reference.
We process your personal data in accordance with the Personal Data Protection Ordinance, 2025 (PDPO 2025) and the Cyber Security Act, 2023 of Bangladesh. By using our Services, you consent to the collection, processing, and use of your information as described in the Privacy Policy. You may exercise your data protection rights — including access, correction, deletion, and portability — as detailed in the Privacy Policy.
In the event of a data breach, we will notify the relevant authorities and affected users within 72 hours, as required by the PDPO 2025.
9. Disclaimers
9.1 No Financial Advice
The Services are tools to help you track and organize your financial information. Nothing in our Services constitutes financial, accounting, tax, investment, or legal advice. You should consult a qualified professional for advice specific to your situation.
9.2 "As Is" Basis
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
We do not warrant that: (a) the Services will function uninterrupted, securely, or error-free; (b) the results obtained from using the Services will be accurate or reliable; or (c) any errors in the Services will be corrected within a specific timeframe.
9.3 Accuracy of User Data
We are not responsible for the accuracy, completeness, or reliability of any financial data you enter into the Services. The outputs and reports generated are based solely on the data you provide.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY THE LAWS OF BANGLADESH, IN NO EVENT SHALL HISHEBI BUSINESS, HISHEBI SOFTWARES, ITS DEVELOPER, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR (B) BDT 5,000 (FIVE THOUSAND TAKA).
Nothing in this section shall exclude or limit liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded or limited under the laws of Bangladesh.
11. Indemnification
You agree to defend, indemnify, and hold harmless Hishebi Business, Hishebi Softwares, and its developer, affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:
(a) your use of, or inability to use, the Services;\n(b) your violation of these Terms;\n(c) your violation of any applicable law or the rights of a third party;\n(d) any User Content you submit to the Services; or\n(e) any inaccurate, misleading, or fraudulent financial data you enter into the platform.
12. Termination
12.1 Termination by You
You may stop using our Services and delete your account at any time through the account settings. Upon account deletion, we will remove your personal data within 30 days, subject to our legal retention obligations.
12.2 Termination by Us
We may suspend or terminate your access to the Services immediately, without prior notice, if you breach these Terms, engage in fraudulent activity, or pose a security risk to the platform. For other violations, we will provide notice and a reasonable cure period where practicable.
12.3 Effect of Termination
Upon termination, your right to use the Services will immediately cease. We may delete your account and all associated data after 30 days, subject to our data retention obligations under the Personal Data Protection Ordinance, 2025. Provisions of these Terms that by their nature should survive termination shall survive, including Sections 6, 9, 10, 11, 14, 15, and 16.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the revised Terms on this page with an updated "Last Updated" date and by sending an email notification to your registered email address at least 15 days before the changes take effect.
Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Services before the changes take effect.
14. Governing Law and Dispute Resolution
14.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the People's Republic of Bangladesh, including but not limited to the Contract Act, 1872, the Personal Data Protection Ordinance, 2025, the Cyber Security Act, 2023, and the Consumer Rights Protection Act, 2009, without regard to conflict of law provisions.
14.2 Dispute Resolution
Any dispute arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good-faith negotiation between the parties for a period of 30 days. If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the courts of Dhaka, Bangladesh.
14.3 Class Action Waiver
To the extent permitted by the laws of Bangladesh, you waive any right to participate in class action lawsuits or class-wide arbitration against Hishebi Business.
15. Grievance Redressal
If you have any grievance regarding the Services or these Terms, you may contact our designated Grievance Officer:

Response Time: We will acknowledge your grievance within 7 days and endeavor to resolve it within 30 days.
If you are not satisfied with our resolution, you may file a complaint with the National Data Governance Authority established under the National Data Governance Ordinance, 2025, or seek recourse through the appropriate legal channels under Bangladeshi law.
16. General Provisions
16.1 Entire Agreement
These Terms, together with the Privacy Policy and any other agreements incorporated by reference, constitute the entire agreement between you and Hishebi Business regarding the Services and supersede all prior agreements, negotiations, and representations.
16.2 Severability
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
16.3 Waiver
Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative.
16.4 Assignment
You may not assign or transfer these Terms, or any rights or obligations hereunder, without our prior written consent. We may assign these Terms to any successor-in-interest through merger, acquisition, or sale of substantially all assets, with notice to you.
16.5 Force Majeure
We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, cyber-attacks, power failures, or internet infrastructure failures.
16.6 Language
These Terms are provided in English and Bangla. In the event of any conflict between the English and Bangla versions, the English version shall prevail.

• আপনার বয়স কমপক্ষে ১৮ বছর।\n• বাংলাদেশের চুক্তি আইন, ১৮৭২ অনুসারে আপনার এই শর্তাবলীতে প্রবেশ করার আইনগত সক্ষমতা আছে।\n• আপনি কেবল বৈধ উদ্দেশ্যে সেবা ব্যবহার করবেন।\n• কোনো প্রযোজ্য আইন বা সরকারি আদেশ আপনাকে সেবা ব্যবহার থেকে নিষিদ্ধ করেনি।\n• আপনার দেওয়া তথ্য সঠিক, বর্তমান এবং সম্পূর্ণ।
৩. অ্যাকাউন্ট নিবন্ধন
৩.১ অ্যাকাউন্ট তৈরি
আমাদেরসেবার নির্দিষ্ট কিছু ফিচারব্যবহার করতে আপনাকে একটিঅ্যাকাউন্ট তৈরি করতে হবে। নিবন্ধনের সময়সঠিক, বর্তমান এবং সম্পূর্ণ তথ্যপ্রদান করতে এবং সেগুলোআপডেট রাখতে সম্মত হচ্ছেন।
৩.২ অ্যাকাউন্ট নিরাপত্তা
আপনি দায়ী থাকবেন:
• আপনার অ্যাকাউন্টের তথ্য (ইউজারনেম ও পাসওয়ার্ড) গোপন রাখার জন্য।\n• আপনার অ্যাকাউন্টের অধীনে সংঘটিত সকল কার্যকলাপের জন্য।\n• অননুমোদিত ব্যবহার বা নিরাপত্তা লঙ্ঘন হলে অবিলম্বে mdtayobur.rahman@hishebisoftwares.com-এ জানানোর জন্য।
আপনার অ্যাকাউন্টের নিরাপত্তা বজায় রাখতে ব্যর্থ হলে সৃষ্ট কোনো ক্ষতির জন্য আমরা দায়ী থাকব না।
৩.৩ অ্যাকাউন্ট বাতিল
আপনি এই শর্তাবলী লঙ্ঘন করলে, প্রতারণামূলক কার্যকলাপে জড়িত হলে, বা নিরাপত্তা ঝুঁকি তৈরি করলে আমরা আপনার অ্যাকাউন্ট স্থগিত বা বাতিল করার অধিকার রাখি। যেখানে সম্ভব, আমরা পূর্ব-বিজ্ঞপ্তি ও প্রতিকারের সুযোগ দেব।
৪. সেবার বিবরণ
হিসেবী বিজনেস একটি আর্থিক ব্যবস্থাপনা ও ব্যবসায়িক ট্র্যাকিং প্ল্যাটফর্ম যা নিম্নলিখিত সুবিধা প্রদান করতে পারে:
• আয় ও ব্যয় ট্র্যাকিং: দৈনিক আর্থিক লেনদেন রেকর্ড, শ্রেণীবদ্ধ ও বিশ্লেষণের সরঞ্জাম।\n• ঋণ ব্যবস্থাপনা: আপনার পাওনা বা দেনা ট্র্যাক করার ফিচার।\n• সঞ্চয় ও বাজেট পরিকল্পনা: সঞ্চয় লক্ষ্য নির্ধারণ ও বাজেট পরিচালনার সরঞ্জাম।\n• ব্যবসায়িক প্রতিবেদন: আপনার আর্থিক তথ্যের সারসংক্ষেপ ও ভিজ্যুয়াল রিপোর্ট।\n• গৃহ মালিক ও ব্যবসা টুলকিট: ক্ষুদ্র ব্যবসায়ী ও গৃহ ব্যবস্থাপনার জন্য অতিরিক্ত সরঞ্জাম।
আমরা যেকোনো সময় সেবার যেকোনো দিক পরিবর্তন, স্থগিত বা বন্ধ করার অধিকার রাখি। প্রদত্ত ফিচারে উল্লেখযোগ্য পরিবর্তন হলে আমরা যথাসম্ভব পূর্ব-বিজ্ঞপ্তি দেওয়ার চেষ্টা করব।
৫. গ্রহণযোগ্য ব্যবহার
৫.১ অনুমোদিত ব্যবহার
আপনিকেবলমাত্র এই শর্তাবলী ও বাংলাদেশের প্রযোজ্য আইন অনুসারে ব্যক্তিগত বা ব্যবসায়িক আর্থিক ব্যবস্থাপনার উদ্দেশ্যে আমাদেরসেবা ব্যবহার করতে পারেন।
৫.২ নিষিদ্ধ আচরণ
আপনি সম্মত হচ্ছেন যে আপনি করবেন না:
• বাংলাদেশের সাইবার নিরাপত্তা আইন, ২০২৩ সহ কোনো আইন বা বিধি লঙ্ঘন করে সেবা ব্যবহার।\n• প্ল্যাটফর্মে ভুল, বিভ্রান্তিকর বা প্রতারণামূলক তথ্য প্রবেশ।\n• সেবার কোনো অংশ, অন্য অ্যাকাউন্ট বা সংযুক্ত সিস্টেমে অননুমোদিত প্রবেশের চেষ্টা।\n• অন্য ব্যবহারকারীর সেবা উপভোগে বাধা দেয় এমন আচরণ।\n• ম্যালওয়্যার, ভাইরাস বা অন্যান্য ক্ষতিকর কোড প্রেরণ।\n• আমাদের পূর্ব লিখিত সম্মতি ছাড়া স্বয়ংক্রিয় সরঞ্জাম ব্যবহার করে তথ্য সংগ্রহ।\n• আমাদের সফটওয়্যার রিভার্স ইঞ্জিনিয়ার, ডিকম্পাইল বা ডিসঅ্যাসেম্বল করা।\n• আমাদের লিখিত অনুমতি ছাড়া সেবা বিক্রি, পুনঃবিক্রি বা বাণিজ্যিকভাবে ব্যবহার।\n• কোনো ব্যক্তি বা সত্তার ছদ্মবেশ ধারণ।\n• আমাদের অবকাঠামো ক্ষতিগ্রস্ত করতে পারে এমনভাবে সেবা ব্যবহার।
এই নিষেধাজ্ঞা লঙ্ঘনের ফলে আপনার অ্যাকাউন্ট অবিলম্বে স্থগিত বা বাতিল হতে পারে এবং সাইবার নিরাপত্তা আইন, ২০২৩ অনুসারে দেওয়ানি বা ফৌজদারি দায়বদ্ধতা তৈরি হতে পারে।
৬. মেধা সম্পত্তি
৬.১ আমাদের সম্পত্তি
সেবারসকল বিষয়বস্তু, ফিচার ও কার্যকারিতা — টেক্সট, গ্রাফিক্স, লোগো, আইকন, সফটওয়্যার সহ — হিসেবী বিজনেস (হিসেবীসফটওয়্যারস-এর একটি পণ্য) বা এর লাইসেন্সদাতাদের একচ্ছত্র সম্পত্তি এবং বাংলাদেশের কপিরাইট, ট্রেডমার্ক ও মেধা সম্পত্তি আইন দ্বারা সুরক্ষিত।
৬.২ সীমিত লাইসেন্স
আমরা আপনাকে এই শর্তাবলী অনুযায়ী কেবল ব্যক্তিগত বা অভ্যন্তরীণ ব্যবসায়িক আর্থিক ব্যবস্থাপনার জন্য সেবা ব্যবহারের সীমিত, অ-একচ্ছত্র, অ-হস্তান্তরযোগ্য, প্রত্যাহারযোগ্য লাইসেন্স প্রদান করছি।
৬.৩ আপনার কন্টেন্ট
আপনি সেবায় প্রবেশ করানো সকল আর্থিক তথ্য ও কন্টেন্টের ("ব্যবহারকারী কন্টেন্ট") পূর্ণ মালিকানা ধরে রাখেন। আমরা আপনার তথ্যের মালিকানা দাবি করি না এবং আপনার স্পষ্ট সম্মতি ছাড়া সেবা প্রদান ব্যতীত অন্য কোনো উদ্দেশ্যে ব্যবহার করব না।
৬.৪ ফিডব্যাক
আপনি স্বেচ্ছায় পরামর্শ বা ফিডব্যাক দিলে, আমরা কোনো ক্ষতিপূরণ বা কৃতজ্ঞতা জ্ঞাপনের বাধ্যবাধকতা ছাড়াই তা ব্যবহার করতে পারি। এটি আপনার ব্যবহারকারী কন্টেন্টের অধিকারকে প্রভাবিত করে না।
৭. সাবস্ক্রিপশন ও পেমেন্ট শর্তাবলী
৭.১ বিনামূল্যে ও প্রদত্ত পরিকল্পনা
আমরা বিনামূল্যে এবং প্রদত্ত উভয় সাবস্ক্রিপশন টায়ার অফার করতে পারি। নির্দিষ্ট ফিচার, সীমা এবং মূল্য আমাদের ওয়েবসাইটে বর্ণিত থাকবে।
৭.২ বিলিং

৭.৩ বাতিলকরণ
আপনিযেকোনো সময় অ্যাকাউন্ট সেটিংসথেকে প্রদত্ত সাবস্ক্রিপশন বাতিলকরতে পারেন। বাতিল বর্তমান বিলিংপিরিয়ড শেষে কার্যকর হবে। কোনো রিফান্ড — সাবস্ক্রিপশন পিরিয়ডের অব্যবহৃত অংশের আনুপাতিক রিফান্ড সহ — দেওয়া হবে না। বিস্তারিত জানতে আমাদের রিফান্ড নীতিমালা দেখুন।
৭.৪ মূল্য পরিবর্তন
আমরা যেকোনো সময় মূল্য পরিবর্তনের অধিকার রাখি। বিদ্যমান সাবস্ক্রাইবারদের জন্য মূল্য বৃদ্ধির কমপক্ষে ৩০ দিন পূর্বে নোটিশ দেওয়া হবে। নতুন মূল্য কার্যকর হওয়ার আগে আপনি বাতিল করতে পারেন।
৮. গোপনীয়তা ও তথ্য সুরক্ষা
আমাদের সেবা ব্যবহার আমাদের গোপনীয়তা নীতি (https://hishebibusiness.com/privacy-policy) দ্বারা পরিচালিত, যা এই শর্তাবলীর অংশ হিসেবে অন্তর্ভুক্ত।
আমরা বাংলাদেশের ব্যক্তিগত তথ্য সুরক্ষা অধ্যাদেশ, ২০২৫ (PDPO 2025) এবং সাইবার নিরাপত্তা আইন, ২০২৩ অনুসারে আপনার তথ্য প্রক্রিয়া করি। তথ্য লঙ্ঘন হলে, PDPO 2025 অনুসারে ৭২ ঘণ্টার মধ্যে সংশ্লিষ্ট কর্তৃপক্ষ ও ক্ষতিগ্রস্ত ব্যবহারকারীদের জানাব।
৯. দায়মুক্তি ঘোষণা
৯.১ কোনো আর্থিক পরামর্শ নয়
আমাদেরসেবা আপনার আর্থিক তথ্যট্র্যাক ও সংগঠিত করারসরঞ্জাম। সেবায় কিছুই আর্থিক, হিসাবরক্ষণ, কর, বিনিয়োগ বা আইনি পরামর্শ গঠন করে না। আপনারপরিস্থিতি অনুযায়ী যোগ্য পেশাদারের পরামর্শ নিন।
৯.২ "যেমন আছে" ভিত্তিতে
সেবাসমূহ কোনো প্রকার ওয়ারেন্টি ছাড়াই "যেমন আছে" এবং "যেমন পাওয়া যায়" ভিত্তিতে প্রদান করা হয়। আমরা নিশ্চয়তা দিই না যে: (ক) সেবা নিরবচ্ছিন্ন বা ত্রুটিমুক্ত হবে; (খ) ফলাফল সঠিক বা নির্ভরযোগ্য হবে; বা (গ) ত্রুটি নির্দিষ্ট সময়ে সংশোধিত হবে।
৯.৩ ব্যবহারকারী তথ্যের সঠিকতা
আপনি সেবায়প্রবেশ করানো আর্থিক তথ্যেরসঠিকতা, সম্পূর্ণতা বা নির্ভরযোগ্যতার জন্যআমরা দায়ী নই। উৎপন্নপ্রতিবেদন সম্পূর্ণরূপে আপনার দেওয়াতথ্যের উপর ভিত্তি করে।
১০. দায়বদ্ধতার সীমাবদ্ধতা
বাংলাদেশের আইন দ্বারা সর্বাধিক অনুমোদিত পরিমাণে, হিসেবী বিজনেস, হিসেবী সফটওয়্যারস, এর ডেভেলপার, কর্মকর্তা, কর্মচারী, প্রতিনিধি বা লাইসেন্সদাতারা কোনো পরোক্ষ, আকস্মিক, বিশেষ, পরিণামগত বা শাস্তিমূলক ক্ষতির জন্য, বা মুনাফা, রাজস্ব, তথ্য বা ব্যবসায়িক সুযোগের ক্ষতির জন্য দায়ী থাকবে না।
এই শর্তাবলী বা সেবা সংক্রান্ত সকল দাবির জন্য আমাদের মোট সামগ্রিক দায়বদ্ধতা নিম্নলিখিতের মধ্যে যেটি বেশি তা অতিক্রম করবে না: (ক) দাবির পূর্ববর্তী ১২ মাসে আপনি আমাদের প্রদত্ত অর্থ, বা (খ) ৳৫,০০০ (পাঁচ হাজার টাকা)।
এই ধারা অবহেলাজনিত মৃত্যু বা ব্যক্তিগত আঘাত, প্রতারণা, বা বাংলাদেশের আইনে যে দায় বাদ দেওয়া যায় না সেগুলো বাদ দেয় না বা সীমিত করে না।
১১. ক্ষতিপূরণ
আপনি সম্মত হচ্ছেন যে নিম্নলিখিত বিষয় থেকে উদ্ভূত দাবি, দায়, ক্ষতি ও ব্যয়ের (যুক্তিসঙ্গত আইনি ফি সহ) বিরুদ্ধে হিসেবী বিজনেস, হিসেবী সফটওয়্যারস এবং এর ডেভেলপারকে রক্ষা করবেন ও ক্ষতিপূরণ দেবেন:
(ক) আপনার সেবা ব্যবহার বা ব্যবহারে অক্ষমতা;\n(খ) এই শর্তাবলী লঙ্ঘন;\n(গ) প্রযোজ্য আইন বা তৃতীয় পক্ষের অধিকার লঙ্ঘন;\n(ঘ) আপনার জমা দেওয়া ব্যবহারকারী কন্টেন্ট; বা\n(ঙ) প্ল্যাটফর্মে প্রবেশ করানো ভুল, বিভ্রান্তিকর বা প্রতারণামূলক আর্থিক তথ্য।
১২. সমাপ্তি
১২.১ আপনার দ্বারা সমাপ্তি
আপনিযেকোনো সময় অ্যাকাউন্ট সেটিংসথেকে সেবা ব্যবহার বন্ধও অ্যাকাউন্ট মুছে ফেলতেপারেন। অ্যাকাউন্ট মুছলে, আইনিসংরক্ষণ বাধ্যবাধকতা সাপেক্ষে ৩০ দিনের মধ্যে আপনারব্যক্তিগত তথ্য মুছে ফেলাহবে।
১২.২ আমাদের দ্বারা সমাপ্তি
এই শর্তাবলী লঙ্ঘন করলে, প্রতারণামূলক কার্যকলাপে জড়িত হলে, বা প্ল্যাটফর্মে নিরাপত্তা ঝুঁকি তৈরি করলে আমরা পূর্ব-বিজ্ঞপ্তি ছাড়াই আপনার প্রবেশাধিকার স্থগিত বা বাতিল করতে পারি। অন্যান্য লঙ্ঘনের ক্ষেত্রে, যেখানে সম্ভব বিজ্ঞপ্তি ও প্রতিকারের সুযোগ দেওয়া হবে।
১২.৩ সমাপ্তির প্রভাব
সমাপ্তির পর আপনার সেবা ব্যবহারের অধিকার অবিলম্বে বন্ধ হবে। ব্যক্তিগত তথ্য সুরক্ষা অধ্যাদেশ, ২০২৫ অনুসারে তথ্য সংরক্ষণ বাধ্যবাধকতা সাপেক্ষে ৩০ দিন পর আপনার অ্যাকাউন্ট ও সংশ্লিষ্ট তথ্য মুছে ফেলা হতে পারে। এই শর্তাবলীর যে ধারাগুলো প্রকৃতিগতভাবে সমাপ্তির পরেও বলবৎ থাকা উচিত, সেগুলো বলবৎ থাকবে — ধারা ৬, ৯, ১০, ১১, ১৪, ১৫ এবং ১৬ সহ।
১৩. শর্তাবলী পরিবর্তন
আমরা যেকোনো সময় এই শর্তাবলী পরিবর্তনের অধিকার রাখি। উল্লেখযোগ্য পরিবর্তন হলে, পরিবর্তন কার্যকর হওয়ার কমপক্ষে ১৫ দিন পূর্বে আপডেটেড "সর্বশেষ আপডেট" তারিখসহ সংশোধিত শর্তাবলী এই পেজে প্রকাশ করব এবং আপনার নিবন্ধিত ইমেইলে বিজ্ঞপ্তি পাঠাব।
পরিবর্তন কার্যকর হওয়ার পর সেবা ব্যবহার চালিয়ে যাওয়া সংশোধিত শর্তাবলীর প্রতি আপনার সম্মতি হিসেবে গণ্য হবে। সম্মত না হলে, পরিবর্তন কার্যকর হওয়ার আগেই সেবা ব্যবহার বন্ধ করতে হবে।
১৪. প্রযোজ্য আইন ও বিরোধ নিষ্পত্তি
১৪.১ প্রযোজ্য আইন
এই শর্তাবলী গণপ্রজাতন্ত্রী বাংলাদেশের আইন দ্বারা পরিচালিত ও ব্যাখ্যা করা হবে, যার মধ্যে রয়েছেচুক্তি আইন, ১৮৭২, ব্যক্তিগত তথ্যসুরক্ষা অধ্যাদেশ, ২০২৫, সাইবারনিরাপত্তা আইন, ২০২৩, এবং ভোক্তা অধিকার সংরক্ষণ আইন, ২০০৯।
১৪.২ বিরোধ নিষ্পত্তি
এই শর্তাবলী বা সেবা সংক্রান্ত যেকোনো বিরোধ প্রথমে ৩০ দিনের সদিচ্ছা আলোচনার মাধ্যমে সমাধানের চেষ্টা করা হবে। আলোচনা ব্যর্থ হলে, বিরোধ ঢাকা, বাংলাদেশের আদালতের একচেটিয়া এখতিয়ারের অধীন হবে।
১৪.৩ শ্রেণি মামলা পরিত্যাগ
বাংলাদেশের আইন দ্বারা অনুমোদিত পরিমাণে, আপনি হিসেবী বিজনেসের বিরুদ্ধে শ্রেণি মামলা বা শ্রেণিভিত্তিক সালিশে অংশগ্রহণের অধিকার পরিত্যাগ করছেন।
১৫. অভিযোগ প্রতিকার ব্যবস্থা
সেবা বা এই শর্তাবলী সম্পর্কে আপনার কোনো অভিযোগ থাকলে, আমাদের মনোনীত অভিযোগ কর্মকর্তার সাথে যোগাযোগ করুন:

১৬. সাধারণ বিধানসমূহ
১৬.১ সম্পূর্ণ চুক্তি
এই শর্তাবলী, গোপনীয়তা নীতিএবং রেফারেন্স দ্বারা অন্তর্ভুক্ত অন্যান্য চুক্তিসহ, সেবা সম্পর্কে আপনারও হিসেবী বিজনেসের মধ্যেসম্পূর্ণ চুক্তি গঠন করে এবং পূর্ববর্তী সকল চুক্তি ও আলোচনাবাতিল করে।
১৬.২ বিচ্ছেদযোগ্যতা
এই শর্তাবলীর কোনো ধারা অবৈধ বা অপ্রয়োগযোগ্য হলে, সেই ধারা ন্যূনতম প্রয়োজনীয় পরিমাণে সীমিত বা বাদ দেওয়া হবে এবং অবশিষ্ট ধারাসমূহ পূর্ণ বলবৎ থাকবে।
১৬.৩ মওকুফ
এই শর্তাবলীর কোনো অধিকার বা ধারা প্রয়োগে আমাদের ব্যর্থতা সেই অধিকার বা ধারার মওকুফ হিসেবে গণ্য হবে না। যেকোনো মওকুফ লিখিত ও অনুমোদিত প্রতিনিধি কর্তৃক স্বাক্ষরিত হতে হবে।
১৬.৪ হস্তান্তর
আমাদের পূর্ব লিখিত সম্মতি ছাড়া আপনি এই শর্তাবলী বা এর অধীনে কোনো অধিকার বা বাধ্যবাধকতা হস্তান্তর করতে পারবেন না। একীভূতকরণ, অধিগ্রহণ বা সম্পদ বিক্রির মাধ্যমে আমরা এই শর্তাবলী হস্তান্তর করতে পারি — আপনাকে বিজ্ঞপ্তি দেওয়া হবে।
১৬.৫ অপ্রতিরোধ্য ঘটনা
আমাদের যুক্তিসঙ্গত নিয়ন্ত্রণের বাইরের কারণে — প্রাকৃতিক দুর্যোগ, মহামারী, সরকারি পদক্ষেপ, সাইবার-আক্রমণ, বিদ্যুৎ বিভ্রাট বা ইন্টারনেট অবকাঠামো ব্যর্থতা সহ — কোনো ব্যর্থতা বা বিলম্বের জন্য আমরা দায়ী থাকব না।
১৬.৬ ভাষা
এই শর্তাবলী ইংরেজি ও বাংলায় প্রদান করা হয়েছে। ইংরেজি ও বাংলা সংস্করণের মধ্যে কোনো বিরোধ হলে ইংরেজি সংস্করণ প্রাধান্য পাবে।
